1. Acceptance of Terms

These Terms of Service ("Terms") are an agreement between you and Pepteeva Health, LLC ("Pepteeva Health," "we," "our," or "us"), an Ohio limited liability company. By accessing or using the Pepteeva Health platform ("Service"), you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Pepteeva Health is a telehealth platform that connects patients with licensed healthcare providers for personalized wellness programs including, but not limited to, GLP-1 weight management, hormone therapy, peptide protocols, and longevity programs. Pepteeva Health is not a medical provider. Medical services are provided by independently licensed practitioners.

3. Service Requirements

You must be at least 18 years of age and a legal resident of a U.S. state where our services are available. By using the Service, you represent and warrant that you meet these requirements.

4. Medical Disclaimer

The information provided through our Service is for educational purposes only and does not constitute medical advice. All medical decisions should be made in consultation with your licensed healthcare provider. In case of a medical emergency, call 911 or go to your nearest emergency room immediately.

5. Subscriptions and Payments

Certain features of the Service require a paid subscription. All fees are stated in U.S. dollars. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You may cancel your subscription at any time by contacting our support team at info@pepteevahealth.com.

You will see a charge from our trusted telehealth partner, LocumTele.

6. Refund Policy

Refunds are governed by our Refund Policy, which is incorporated into these Terms by reference. In summary:

• If an independent licensed provider determines after your consultation that a prescription-based treatment is not appropriate for you, the amount paid for that medication or product will be refunded.
• Refunds for unused subscription periods may be requested within 30 days of the charge.
• Compounded medications, once dispensed by our pharmacy partner, are non-refundable under applicable pharmacy regulations.
• Orders cancelled before shipment or dispensing, and paid orders that cannot be fulfilled, are eligible for a refund.
• Lab testing fees are non-refundable once the kit has been shipped.

7. Privacy and HIPAA

Your privacy is important to us. Our collection and use of personal health information is governed by our Privacy Policy and applicable federal and state laws, including the Health Insurance Portability and Accountability Act (HIPAA). By using our Service, you consent to the collection and use of information as described in our Privacy Policy.

8. Prohibited Conduct

You agree not to: (a) use the Service for any unlawful purpose; (b) impersonate any person or entity; (c) submit false or misleading health information; (d) attempt to gain unauthorized access to any part of the Service; or (e) interfere with the proper operation of the Service.

9. Limitation of Liability

To the maximum extent permitted by law, Pepteeva Health and its officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claims shall not exceed the amount paid by you to Pepteeva Health in the 12 months preceding the claim.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved in the state or federal courts located in Hamilton County, Ohio, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any rights you may have under applicable consumer protection laws.
